What is process serving?
Process serving is the formal delivery of legal documents to a named party, carried out so that service can be proven to a court. We serve documents Australia-wide and provide an affidavit of service on completion.
Service is a procedural requirement, not an administrative one. If it is not carried out correctly, or cannot be proven, the matter does not advance — hearings are adjourned, default judgments are set aside, and costs follow. The affidavit is as important as the attendance.
Where the party cannot be found at the address on file, service and tracing are handled together rather than as two separate engagements.

Why it matters
Unserved is not the same as unservable
A file returned "unable to serve" after a single daytime attendance is not a serious attempt. Parties avoiding service are rarely home at 11am on a Tuesday, and an address that is months old is frequently no longer current.
We plan attendance around when the party is actually likely to be there, and where the address proves stale we trace a current one rather than closing the file. Tracing and serving in the same engagement is faster and cheaper than discovering the problem and starting again.

When personal service cannot be effected
Some parties cannot be personally served — they have left the jurisdiction, are deliberately evading, or cannot be located at any traced address. We document every attempt in detail, because that record is what supports an application for substituted service.
We will tell you when we believe personal service is not achievable and substituted service is the appropriate next step, rather than continuing to bill for attendances unlikely to succeed.

All work is conducted in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and under the regulations applying to licensed inquiry agents in each state. We collect only information necessary for the engagement, use it only for that purpose, and hold all documentation securely.

How much does process serving cost in Australia?

Do you provide an affidavit of service?
Yes. Every completed service is supported by a sworn affidavit recording the date, time, place and manner of service, in a form ready for filing.
Do you serve documents outside Victoria?
Yes. We serve Australia-wide, in every state and territory, across metropolitan and regional areas.
What happens if the person is not at the address?
We record the attempt and, where you instruct us to, trace a current address and attend there. Handling tracing and service together avoids the delay of closing the file and re-engaging.
What if the person refuses to accept the documents?
Refusal does not defeat service. Where a party is correctly identified and declines to take the documents, service can still be effected and the circumstances are recorded in the affidavit.
How quickly can documents be served?
Timing depends on location and any deadline in the matter. Tell us the date by which service must be effected and we will confirm whether it is achievable before you instruct.
Can you serve documents on a company?
Yes — including service at a registered office. Where a company's registered address is not current, a company and director search will establish the correct service address.
What is substituted service?
Where personal service cannot be effected, a court may permit service by another means — post, email or social media, for example. Our record of attempts is the evidence that supports that application.
