Terms of Engagement

These terms apply to services provided by Skip Tracing and Locations Australia Pty Ltd, trading as People Trackers Australia (ABN 52 675 822 349), unless varied in writing.
Engagement
An engagement begins when you accept a written quote. Quotes set out the scope, the fee and the expected turnaround. We do not commence work before acceptance.
We may decline an engagement, or cease work on one already accepted, where the purpose is not lawful or legitimate, where an intervention order or similar protective order may be in place, or where the information supplied proves materially inaccurate.
Your obligations
You warrant that you have a lawful and legitimate purpose for the engagement, that you are entitled to provide us with the information you supply, and that the information is accurate so far as you are aware. The accuracy of what you provide materially affects the result.
You agree not to use information we provide for any purpose other than the one disclosed to us, and not to use it to harass, intimidate or threaten any person.
Fees and payment
Fees are fixed and confirmed in writing before work begins, except for field work and surveillance, which are charged hourly with expected duration agreed in advance. Prices shown on this website are indicative starting points and exclude GST.
Fees are payable for the work performed. We do not operate on a "no find, no fee" basis: where a search is properly conducted but does not produce a confirmed result, the fee remains payable and you receive the full record of searches performed.
Where the scope of a matter changes materially after acceptance, we will tell you and seek your agreement before incurring additional fees.
What we deliver
We provide a written report setting out the result, the searches performed, and the information obtained at each stage, together with a clear statement of anything that could not be confirmed.
We do not guarantee a result. Some subjects cannot be located — they may have departed Australia, be deceased without a recorded notification, or have no accessible recent footprint. We assess viability honestly before accepting an engagement precisely so that this outcome is rare.
Confidentiality
We keep your engagement, your identity and the information you supply confidential. The subject of an engagement is not contacted or alerted unless you specifically instruct it.
We may disclose information where required or authorised by law, including in response to a court order, subpoena, or a lawful request from a regulator or law enforcement agency.
Privacy
Personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. See our privacy policy. Where an engagement relates to debt recovery, our conduct also follows the joint ACCC and ASIC Debt Collection Guideline.
Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
Subject to that, our liability arising out of an engagement is limited, at our option, to re-performing the services or refunding the fee paid for them. We are not liable for decisions you take on the basis of a report, or for consequential loss.
Licensing
We are licensed by Victoria Police under the Private Security Act 2004 (Vic). Investigator licensing in Australia is administered state by state, and work in each jurisdiction is conducted in accordance with the requirements applying there. More on licensing and compliance.
Governing law
These terms are governed by the laws of Victoria, Australia.
